Terms of use

1. Who we are and what these terms cover

KeepCourse is provided by Predict Ventures, Inc., 16192 Coastal Highway, Lewes, Delaware 19958, United States ("we", "us"). Contact: keepcourse@predict.ventures.

These terms apply to the KeepCourse app (on the web, Android and, later, iPhone), the website keepcourse.app, the feedback board, and KeepCourse Pro (together, "KeepCourse"). By using KeepCourse you agree to these terms. Our privacy policy at keepcourse.app/privacy explains how we handle personal data.

If you download KeepCourse from Google Play or the App Store, that store's terms also apply to the download and to any purchase you make there.

2. Who can use KeepCourse

You must be at least 16 years old. If you use KeepCourse on behalf of a company, you confirm you're allowed to accept these terms for it.

3. Not medical advice

KeepCourse is a personal planning, habit and reflection tool. It is not a medical device and does not give medical, psychological, nutritional or other professional advice. Readouts such as the sleep, energy and mood summaries are general prompts, not health assessments.

Breathing exercises, workouts and any routine you build are done at your own pace and your own risk. Stop if you feel dizzy, unwell or in pain, and talk to a doctor before starting new exercise if you have a health condition. If you are struggling or in crisis, contact a professional or your local emergency number; KeepCourse is not a support service.

4. Your data and your responsibility for it

In the current version, everything you enter stays on your device. We don't keep a copy, so we can't recover it. Deleting the app or clearing its data (including your browser's site data for the web version) deletes your entries permanently, and they won't move to a new phone. You're responsible for your device and for keeping it secure. We'll tell you before this changes, for example when we add accounts and sync.

5. The beta

KeepCourse is in beta. Features may change, move to Pro, or be removed, and the app may contain bugs. We'll try to keep what you have working and tell you about important changes. We promise one thing in particular: the daily routine (standup, commits, streaks, golden hour, breathing, evening close, diary, weekly targets and review) will stay free.

6. KeepCourse Pro

Plans and price. Pro is offered at $9.99 a month or $49.99 a year, with a 7-day free trial, plus any taxes that apply. The price shown at checkout is the price you pay.

Where you buy. On our website, payments are processed by Stripe. In the Android or iPhone app (when offered), purchases are made through Google Play or the App Store under their terms, and those stores handle billing, cancellation and refunds.

Free trial. If you start a trial, you won't be charged until it ends. We'll remind you at least 2 days before. Cancel before the trial ends and you won't pay.

Renewal. Subscriptions renew automatically at the end of each month or year until you cancel. You can cancel at any time; Pro stays active until the end of the period you've paid for.

During the beta. Paying for Pro during the beta supports development and locks in your price for as long as your subscription continues. Because the app doesn't have accounts yet, Pro features are unlocked using the email address you paid with once accounts are available.

Price changes. We may change prices for new subscribers at any time. For existing subscribers, we'll give at least 30 days' notice before a change applies, and you can cancel before it does.

Refunds and your right to withdraw. If you live in the EU or UK, you normally have 14 days to withdraw from a purchase. For a subscription bought on our website, you can cancel within 14 days of your first payment for a full refund. Outside that, we don't give partial refunds for unused time, but if something went wrong, email us and we'll look at it fairly.

Don't misuse KeepCourse: no attempting to break, overload or reverse-engineer it, bypass payments, scrape the website or feedback board, or use it to harm others or break the law.

9. Ownership

KeepCourse, its design, name, logo, text and code belong to Predict Ventures, Inc. We give you a personal, non-transferable licence to use KeepCourse for your own, non-commercial purposes under these terms. Your entries remain yours.

10. Other services

KeepCourse relies on other services, such as Stripe for payments, Netlify for the website, and Google Play and the App Store for distribution. Their own terms apply to them, and we aren't responsible for their availability.

11. Disclaimers and liability

We build KeepCourse with care, but we provide it "as is" and "as available", without promising that it will be uninterrupted, error-free, or that it will achieve any particular result for you.

To the extent the law allows, we aren't liable for indirect or consequential losses, or for loss of data stored on your device. Our total liability to you for any claim is limited to the amount you paid us for KeepCourse in the 12 months before the claim, or $50 if you paid nothing.

Nothing in these terms limits liability that can't legally be limited, such as for death or personal injury caused by negligence, or for fraud, and nothing affects your statutory rights as a consumer.

12. Ending your use

You can stop using KeepCourse at any time by deleting the app and cancelling any subscription. We may suspend or end access for anyone who seriously or repeatedly breaks these terms. If we stop offering KeepCourse or Pro, we'll give reasonable notice and refund any prepaid period you can no longer use.

13. Changes to these terms

We may update these terms as KeepCourse changes. For important changes, we'll tell you in the app or by email at least 30 days before they apply. If you keep using KeepCourse after that, the new terms apply; if you don't agree, you can stop using it and cancel.

14. Law and disputes

These terms are governed by the laws of the State of Delaware, United States. If you're a consumer in the EU or UK, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts. Please contact us first; most things can be sorted out by email.
